What is my auto injury worth?

This is a question that is often asked by my prospective clients. Many injury attorneys try to attract clients by advertising that they can tell you what your case is worth. You should be aware of ANYONE who tells you they can tell you upfront what your case is worth.  Many injury lawyers will post on their websites various damage calculators which purport to allow you to calculate the value of your case or sometimes they post a very brief questionnaire asking you very basic information which is designed to get you to respond so that the firm can contact you in hope of convincing you to become a client. Slick marketing tactics may convince you to hire a certain law firm, but they can’t tell you what your case is really worth. Many factors go into determining the value of a case – whether that be the trial value or the settlement value. For instance, does the person have pre-existing conditions which may explain their complaints/ restrictions in activities? Did the person suffer a concussion/ closed head injury in the collision? Were the injuries which required surgery and which may have long term chronic consequences? Are there issues of who was at fault in causing the collision or questions regarding causation of injuries or damages? Are there insurance issues or health care reimbursement issues which will affect the net recovery. A lot of information and data needs to be closely evaluated. Insurance coverage issues need to be closely evaluated. Issues related to reimbursement benefits to be provided by health insurers need to be evaluated Are you a Medicaid or Medicare recipient? If so, a whole host of issues need to be addressed with regard to the settlement and reimbursement of the state of federal government. There are so many other tactics…
